WHAT IS MEDIATION?
Mediation is a process designed to help disputing parties resolve their conflict. In mediation, a trained professional, known as a mediator, works with the parties to negotiate a mutually acceptable solution to their dispute. Mediators do not act as advocates or render judgments; the parties control the outcome.
WHAT KINDS OF DISPUTES CAN BE MEDIATED?
Mediation is appropriate for nearly all types of business-related issues, including: Contracts; Joint Ventures; Insurance, Services, Bankruptcy; Employment; Banking; Construction; and many others.
WHAT ARE THE BENEFITS OF MEDIATION?
Mediation saves money. Court costs and legal fees can be substantial burdens to businesses. In contrast, mediation provides a cost-effective alternative. The cost of mediation is reasonable and is agreed upon up-front; there are no hidden or unexpected charges.
Mediation saves time. Mediations can be scheduled at the convenience of the disputing parties. Typically, a mediation lasts 2-4 hours. If necessary follow-up sessions can be scheduled within a short time. In litigation, disputants can wait months or even years before their case comes to court.
Mediation is successful. Studies show that in the United States 80%of parties who have undergone mediation are satisfied with the results. In the “win-lose” scenario of litigation, not more than half of the parties can be satisfied, and many of the “winners” find little to celebrate.
Mediation is confidential. Mediation proceedings are not made available to any outside parties. The privacy of the mediation process allows parties to protect the integrity and reputation of their businesses.
Mediation keeps the parties in control. In mediation, the parties determine the solutions to their disputes, through the guidance of professional mediators. This allows for a far greater and more creative range of outcomes than through litigation.
